The AAR OFFERS
THE INFORMATION AND SERVICES AT https://www.aarweb.org AND ALL AFFILIATED WEBSITES (collectively, the "Site") SUBJECT TO
THESE TERMS AND CONDITIONS OF USE (the "Terms").
Acceptance.
Each time you use or
cause access to this Site, you are agreeing to be bound by these Terms.
Particular portions of the Site may also subject you to additional rules or
guidelines. By using the Site, you represent and warrant that you have
the right, authority, and capacity to enter into this agreement and to abide by
all of the terms and conditions set forth below and elsewhere on the Site.
Site
Changes. The AAR
may, at any time and without notice or liability to you, temporarily or
permanently (i) modify or discontinue any aspect of this Site or your access to
it, and (ii) delete any data you provide to the Site. The AAR is not
responsible or liable for the timeliness, deletion, failure to store,
inaccuracy, or improper delivery of any data or information on this Site or for
your inability to access it.
Your
Conduct. All
information in whatever form ("Content") available on the Site shall
be the sole responsibility of the person who provided the Content or the person
whose user account is used to provide the Content. Our Site may expose
you to Content that may be objectionable or offensive to you. We will not
be liable to you for the Site's Content or for any error or omission of
Content. All opinions contributed to this Site are those of individual
users and do not reflect the opinions of the AAR.
When you use
this Site or any service provided, you shall not (a) provide any Content or
perform any conduct that may be illegal, threatening, harmful, abusive,
harassing, stalking, tortious, defamatory, libelous, vulgar, obscene,
offensive, or pornographic; or (b) provide any Content that is designed
to or does interfere or interrupt this Site or any service provided, or is
infected with a virus or other programming routine, or gives rise to civil or
criminal liability, or which may violate applicable law, including intellectual
property laws; (c) impersonate or misrepresent your association with any person
or entity, or forge or otherwise seek to conceal or misrepresent the origin of
any Content provided by you; (d) collect or harvest any data about other users;
or (e) provide or use this Site and any Content or service in any commercial
manner or in any manner that would involve junk mail, spam, chain letters,
pyramid schemes, or any other form of unauthorized advertising without our
prior written consent.
By providing any
Content to our Site: (i) you warrant and represent that you have all legal
rights that are associated with such Content; (ii) you grant the AAR a
worldwide, royalty‑free, non‑revocable, non‑exclusive license and any other
necessary right to use, display, reproduce, modify, adapt,
publish, distribute, perform, promote, archive, translate, and create
derivative works and compilations of, in whole or in part, such Content, which
license and any other right shall apply regarding any form, media, technology
now known or later developed; and (iii) we shall have the right (but not
obligation), in our sole discretion, to refuse publication of or to remove or
block access to any such Content at any time and for any or no reason, with or
without notice.
Registration. When you register with our Site,
you will provide truthful, accurate, and complete information. You are
solely responsible (a) for maintaining the confidentiality and security of your
username and password and (b) for all uses of this Site by any person who logs
on under your registration, user account, or password, whether authorized or
unauthorized by you. You shall immediately notify us of any unauthorized
use of your registration, user account, or password or of any known or
suspected breach of security, including loss, theft, or unauthorized disclosure
or use of your username, password, or IP address. You may not provide access to
the Site to anyone else, including by setting up an anonymous remailer for
purposes of allowing access to the Site.
Third Party
Services. Goods
and services of third parties may be advertised or made available on or through
this Site, including by use of hyperlinks. Such information is provided
for your reference only and does not imply any endorsement of such goods,
services, or third parties or any association with such third parties.
The AAR does not control such third parties or their sites and is not
responsible for their content or your interaction with them.
Employment
Services. Part of
our Site contains various employment-related services. We refer you to
the additional terms that apply to those services.
Eligibility.
To register with us or
use the Site, you must be of legal age to form a binding contract in your jurisdiction
(18 years old in most U.S. jurisdictions). If you are between the ages of
13 and the applicable legal age in your jurisdiction, you can use the Site only
in conjunction with, and under the supervision of, your parent or guardian who
has agreed to the Terms. If you are under the age of 13, you may not use
the Site. If you are the parent or legal guardian of a child under the
age of 18, you may use the Site on behalf of such minor child, and all other
references in these Terms to "you" shall refer both to you and to
such child. Your use of the Site is void where prohibited by applicable
law.
Email
Policy. You may receive periodic emails from the AAR. If you prefer not to receive emails from AAR, you can change your communication preference settings on the “Preferences” tab in your member profile. You can also send an email to [email protected] with "UNSUBSCRIBE" in the subject line, and your preferences will be changes to prevent further emails except for confirmations and other emails relating to your Site registration.
Intellectual
Property. The
Content, materials, and services provided for and depicted on the Site are
protected by copyright, trademark, patent, and other intellectual property laws
and are provided to you for the sole purpose of using the Site. The
"American Academy of Religion," "AAR," and the AAR logo are
trademarks and service marks of the AAR. All other trademarks, service
marks, and logos used in this Site are the intellectual property of their
respective owners. No portion of the materials on such pages may be
republished in any form without the express written permission of the copyright
owner. Except where indicated, all Content on the Site is the property of
the AAR or its affiliates ("AAR Content"). All other all
Content is the property of third parties ("Third Party
Content").
You shall not
copy, alter, create derivative works of, publish, or sell the Content or any
information or services provided by AAR hereunder. AAR may alter the AAR
Content from time to time in its sole discretion. Except as expressly set
forth herein, no license is granted to you for any other purpose, and any other
use of the Site, the services available through the Site, or the AAR Content by
you shall constitute a material breach of these Terms. Nothing in these
Terms shall affect any rights of AAR in the Site, the AAR Content, or any
associated intellectual property rights.
DMCA
Notifications. If you
believe that Content violates your copyright or other rights, please send a
written notice to the AAR directed to [email protected]rweb.org.
Any requests to take down content must comply with the Digital Millennium
Copyright Act of 1998, as amended. If you receive written notice from a
third party that Content or use of the Content constitutes infringement or
defamation, you will notify the AAR promptly. Upon such notification, or
if the AAR learns of such a claim from another source, the AAR may remove such
Content pending the resolution of such claim.
Privacy
Policy. Registration
data and other personally identifiable information we collect are subject to
our Privacy Policy.
Indemnification.
You hereby irrevocably
indemnify and hold us and our affiliates, related parties, officers, directors,
employees, agents, independent contractors, advertisers, partners, joint
venturers, and co‑branders ("Indemnitees") harmless from any claim or
demand, including those for reasonable attorney's fees, that may be made by any
third party and that is due to or arises out of your conduct or connection with
this Site or service, your provision of Content, your violation of these Terms,
or any other violation by you of the rights of another person or party.
Warranty
Disclaimers. THIS
SITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT OR ANY
SITE-RELATED SERVICE, IS PROVIDED "AS IS," AT YOUR OWN RISK, AND WITH
NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT. AAR MAKES NO WARRANTY, IMPLIED OR EXPRESS,
THAT ANY PART OF THE SITE WILL BE UNINTERRUPTED, ERROR‑FREE, VIRUS‑FREE,
TIMELY, SECURE, ACCURATE, RELIABLE, OR OF ANY QUALITY, OR THAT ANY CONTENT IS
SAFE IN ANY MANNER FOR DOWNLOAD. YOU ASSUME TOTAL RESPONSIBILITY AND RISK
FOR YOUR USE OF THIS SITE AND SITE-RELATED SERVICES.
Some
jurisdictions may not allow disclaimers of implied warranties; therefore, some
or all of the above disclaimers may not apply to you.
Liability
Limitations. THE
INDEMNITEES ARE NOT AND WILL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD

USE OF OR THE INABILITY TO USE THE SITE OR SERVICE, (b) UNAUTHORIZED ACCESS TO
OR ALTERATION OF YOUR DATA TRANSMISSIONS, (c) STATEMENTS OR CONDUCT BY YOU OR
BY ANY THIRD PARTY ON THE SITE OR SERVICE, OR (d) ANY OTHER MATTER RELATING TO
THE SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE, SERVICE, OR
CONTENT IS TO STOP USING THE SITE.
IF YOU ARE A
CALIFORNIA RESIDENT, YOU WAIVE YOUR RIGHTS WITH RESPECT TO CALIFORNIA CIVIL
CODE SECTION 1542, WHICH SAYS "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS
WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE
TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE
MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."
Applicable
Law/Jurisdiction. These
Terms, and any dispute arising out of or related to the Terms, this Site, or
your use of this Site or services shall be governed by and construed in
accordance with the laws of the State of Georgia, USA, without regard to its
conflicts of law provisions. Jurisdiction and venue for all such disputes
shall be proper only in the Superior or State Court for DeKalb County, Georgia,
or the United States District Court, Northern District of Georgia, Atlanta
Division. You irrevocably submit to and waive any objection to such
jurisdiction and venue. In any such dispute, the AAR will be
entitled to an award for its costs and reasonable attorneys' fees actually
incurred, whether or not suit is brought.
Miscellaneous.
The failure of either
party to assert any right under these Terms shall not be considered a waiver of
that right. These Terms, and the provisions incorporated by reference
herein or contained elsewhere in the Site, constitute the entire agreement
between the parties pertaining to the subject matter hereof. The AAR may
alter these Terms by posting revisions on the Site. Any claim or cause
arising out of this Site or the services must be filed by you within one year
after such claim or cause arose, otherwise the claim shall be forever
barred. The AAR may assign its rights and obligations under these Terms,
upon which the AAR shall be relieved of any further obligation. If any of
the provisions of these Terms are held to be unenforceable by a competent
authority, such provisions shall be revised to the minimum extent necessary so
that these Terms shall otherwise remain in full force and effect.
